Terms Of Service
This website is operated by Elevated Man, an Australian-registered business. Throughout the site, the terms “we”, “us” and “our” refer to Elevated Man. We offer this website and services conditioned upon your acceptance of the terms, conditions, policies, and notices stated below.By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access the website or use our services.
1. PAYMENT
You authorise Elevated Man’s third-party payment processor to charge your selected payment method for all applicable fees and taxes. All prices are in USD (US Dollars) unless otherwise stated. Currency conversion fees or international charges may be applied by your financial institution. You are responsible for providing accurate billing and contact information. We may suspend or cancel your service if payments are more than 30 days overdue.
2. REFUNDS & CANCELLATIONS
Weekly Subscriptions
You may cancel your subscription at any time by contacting us in writing at info@elevatedman.com.au. Payments already made are non-refundable unless required by law. Your access will continue until the end of the current billing period.
Quarterly, 6-Month Packages & 1:1 Sessions
Packages purchased at a discounted “Paid in Full” rate and 1:1 sessions are not eligible for refunds due to change of mind. However, if the service fails to meet consumer guarantees under Australian Consumer Law, you may be entitled to a remedy including a refund, replacement or compensation.
Your Consumer Rights
We comply with the Australian Consumer Law (ACL). Nothing in these Terms excludes your rights to a remedy where services are not provided with due care and skill, are not fit for purpose, or are not delivered as agreed.
3. COACHING & COUNSELLING SERVICES DISCLAIMER
Our services include coaching programs as well as counselling delivered by licensed professionals. While some of our practitioners may hold qualifications in counselling or psychology, Elevated Man does not provide clinical mental health treatment or crisis intervention unless explicitly stated. Our services are designed to support personal development, relationship growth, and communication skills. They are not a substitute for formal psychological diagnosis or treatment unless you are receiving care from one of our licensed practitioners in that capacity. If you are experiencing serious mental health issues, abuse, or crises, we encourage you to seek support from a qualified health care provider or local emergency services.
4. CLIENT RESPONSIBILITY
You acknowledge that your success in this program depends on your own commitment, effort, and follow-through. Elevated Man does not guarantee reconciliation with your partner or any specific outcome. Our role is to provide tools and support; your results may vary.
5. BOUNDARIES OF SERVICE
Coaching and counselling sessions are provided at scheduled times only and do not include 24/7 access. Our services are not intended to replace emergency or acute care. If you are in distress or facing a crisis, please contact a local support service or professional.
6. RESULTS DISCLAIMER
The testimonials and case studies on our website reflect individual experiences of improved communication, personal insight, or relational progress. However, these are not typical or guaranteed outcomes. Results depend on numerous personal factors and your own participation in the process.
7. SENSITIVE CONTENT
The content of our programs may include discussion of emotionally challenging topics such as conflict, trust issues, or personal behaviour patterns. You are responsible for your emotional well-being during and after participating in our content, and we recommend seeking additional support if required
8. ETHICAL USE OF PROGRAM MATERIALS
Our program is intended to foster respectful, constructive communication and personal growth. You agree not to misuse the tools, language, or strategies taught in this program to manipulate, coerce, or harm others.
9. MODIFICATIONS TO THE SERVICE AND TERMS
We may update these Terms or our services at any time. Significant changes affecting your rights will be communicated with reasonable notice. Continued use of the Service after changes indicates your acceptance. For existing agreements, changes will not apply retroactively without your consent.
10. LIMITATION OF LIABILITY
Our services come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement, refund or compensation for a major failure. To the maximum extent permitted by law, we disclaim liability for indirect or consequential loss.
11. PRIVACY & DATA
We collect, use, and store your personal information in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using our services, you consent to your data being stored in Australia and/or by trusted third-party providers in other countries. You may request access to or correction of your personal information at any time.
12. INTERNATIONAL USERS
Our services are provided from Australia and governed by Australian law. If you access our services from outside Australia (including New Zealand, the United States, the United Kingdom, or Canada), you do so at your own initiative and are responsible for complying with local laws. Nothing in these Terms excludes or limits your rights under mandatory consumer protection laws in your country of residence. By using our services, you consent to your personal information being transferred to and processed in Australia and other countries where our third-party service providers operate.
